Scotland pauses hyperscale data centre decisions

Scotland has tightened planning controls on large data centre developments. Mandatory environmental assessments above 50MW have been followed by a temporary pause on hyperscale decisions while national guidance is prepared.


Scotland has tightened planning controls on large data centres and backed a temporary pause on decisions involving hyperscale developments while national guidance for the sector is prepared.

The Scottish Government announced on 16 September that all proposed data centres with more than 50MW of power capacity will require an Environmental Impact Assessment. The direction takes effect on 17 September and makes assessment mandatory above the threshold rather than leaving the requirement to the existing case-by-case process.

Later the same day, MSPs backed a temporary pause on planning and consent decisions for hyperscale data centres until the government completes national planning guidance. The move stops short of a permanent moratorium but raises the immediate development hurdle for the largest projects.

The environmental direction follows another measure introduced in August requiring planning authorities to notify Scottish Ministers of new data-centre applications within seven days of validation. Together, the changes give ministers considerably greater oversight of a development pipeline being accelerated by artificial intelligence and wider demand for computing capacity.

The government has identified electricity use, water requirements, hardware, greenhouse-gas emissions, landscape effects, biodiversity, soils, noise and air quality among the issues that may need to be examined. Construction and back-up generation can also add to a project’s environmental footprint even where operators intend to source renewable electricity.

Public Finance Minister Hannah Mary Goodlad said: “Ensuring that an Environmental Impact Assessment is always part of the application process will create a level playing field for developers and will ensure potentially significant environmental effects are considered from the outset.”

The measures arrive as data-centre development moves from a specialist property question into a central issue for energy, planning and industrial strategy. Training and operating advanced AI systems requires substantial computing power, while cloud services, enterprise software, digital media and scientific research are increasing demand independently of the AI boom.

Electricity availability is becoming one of the sector’s largest constraints. A hyperscale development can require power on a scale comparable with major industrial facilities, and new connections may depend on grid reinforcement that takes years to complete. Concentrating several projects in the same region can intensify competition for capacity.

Cooling presents a separate infrastructure question. Different technologies carry different water and energy requirements, while local environmental effects vary according to site and design. Developers able to demonstrate efficient cooling, lower-energy architectures, heat reuse and credible renewable-power arrangements may therefore have an advantage as planning scrutiny increases.

The new rules could also alter development economics. Environmental assessment and detailed infrastructure studies increase expenditure before a project has planning certainty, while the temporary pause on decisions adds timing risk. That is particularly relevant to speculative developments whose operators have not yet secured customers or long-term power arrangements.

Scotland nevertheless has reasons to compete for data-centre investment. Projects can support construction work, specialist technical employment and business demand, while computing infrastructure is increasingly treated as a strategic asset. The policy challenge is to capture those benefits without allowing energy-intensive projects to undermine wider climate, grid and community objectives.

The parliamentary pause makes that balancing exercise more explicit. Rather than judging a series of large applications before a common national framework exists, Scotland will use the intervening period to establish planning guidance for the sector.

Smaller data-centre applications remain subject to existing environmental rules, with assessments determined according to established criteria. The government has also said the 50MW direction can be reviewed as evidence and technology develop.

Developers are therefore facing a materially different Scottish planning environment from the one that existed only weeks ago. Large projects will need stronger environmental evidence, and the largest schemes now face a wait for national guidance before decisions proceed. The next question is whether the framework can give investors enough certainty while addressing the power, water and environmental pressures driving the intervention.
